On the highest civil standard of proof applicable to quasi-criminal sequestration proceedings the Court accepted the direct evidence of the primary witness (Hameed), found the contested documents (Exhibit 4/4A) to be forgeries, found the respondents had possession of the gems at the material dates and wilfully disobeyed the Attachment Order and the Order of Penlington, and accordingly granted the plaintiff leave to issue Writs of Sequestration subject to provision for repayment of any surplus to the respondents and costs directions.
