- CACC1340/1977
An admission made in custody or in answer to police questioning can fall within the weaker notion of 'professing' under s.20(2) and thus support a charge of professing membership, but on the facts the conviction as entered (for 'claiming') was unsustainable; the magistrate also improperly relied in part on voir dire material, and the appropriate disposition is to allow the appeal and set aside the sentence.
