Plaintiff proved full repayment by the Defendant's receipt and the Defendant was contractually obliged to discharge the Legal Charge; the charge therefore no longer affects the Property and the Court, exercising its inherent jurisdiction and having found service valid and no defence, was entitled to declare repayment and order removal of the Legal Charge from the Land Registry.
