The plaintiff failed to prove on the balance of probabilities the alleged 1983 or 1991 agreements or that he funded the purchase such as to give rise to a constructive or resulting trust or proprietary estoppel; contemporaneous documentary evidence and credible witness testimony showed the mother funded initial payments and defendant discharged the mortgage; therefore plaintiff's claims fail and, consequentially, under s19 LRO the court vacated the registration of the writ against the property.
