The application to vacate trial dates was dismissed because the defendant failed to demonstrate exceptional circumstances under Order 25 r 1B(3); quarantine inconvenience and health risks did not amount to exceptional circumstances given prior agreement to dates, lack of evidence of impossibility, the availability of videolink as an alternative which was not properly explored, and the prejudice from further delay to the elderly plaintiff.
