The plea was unequivocal and therefore the conviction stands; however, new factual material showing entry on 23 December 2002 supported treatment as an overstaying offence which warranted a reduced sentence. The appellate court reduced the sentence from 12 months to 9 months while dismissing the appeal against conviction.
