The Court held that the Notices of Motion for leave to appeal to the CFA are not reasonably arguable and not of GGPI: the VTD Requirement falls within "normal immigration requirements" under the CIES Rules; the Guidelines on the Immigration Department website form part of the Department's immigration policy and must be met for visa/entry permit grants; therefore both Questions (1) and (2) are unarguable and the application is dismissed with costs awarded.
