On the balance of probabilities the owners present at the 25 October 2023 general meeting did not pass a resolution authorizing commencement of LDBM 169/2023; the chair (聶) therefore lacked valid authorization to file the LDBM application on behalf of the corporation. The tendering provisions s.20A did not apply because retained engagements as contracted did not have a value exceeding or likely to exceed HKD 200,000 at the time of agreement.
