There is no legal basis requiring a beneficiary's separate written consent where an executor (or his attorney) disposes of estate property under the powers in s.54; because the beneficiary and executor were the same person and the assignment was not avoided by interested persons, the purchaser's requisition was unnecessary and the defendant raised a real defence, thus summary judgment was refused and the plaintiff's action dismissed.
