The court held that the validity of the Deed and Declaration of Trust is relevant to the pending proceedings and, exercising its case management powers under the RDC, it may order the Applicant to confirm within a fixed time whether she will seek to set aside or declare void those documents; if she elects not to seek such relief she will be bound by that confirmation for the purposes of these proceedings, and if she does seek such relief the Court will appoint the Official Solicitor as guardian ad litem and allow joinder of the Children due to the conflict of interest with the Applicant.
