The deceased's payment, immediate vacant possession, long continued exclusive possession, improvements and payment of government rents constituted sufficient acts of part performance to take the oral/partly evidenced agreement out of section 3 Cap 219 and justify specific performance; substituted service was valid and the District Court had jurisdiction, therefore default judgment for specific performance was appropriate.
