Plaintiff demonstrated a good arguable case of a proprietary claim and constructive trust, there were assets within the jurisdiction and a real risk of dissipation, the defendant failed to prove absence of alternative funds and did not show likelihood of significant loss to justify fortification; on balance of justice the continuation of the Mareva injunction and a proprietary injunction was justified and the monthly exception must be reduced to nil.
