The statutory regime (O 22A and s18A(1)(b) Legal Aid Ordinance) creates a first charge in favour of the Director on money remaining in court for an aided person; therefore the nisi order directing payment to the Director was correctly made and the variation application, unsupported by sufficient evidence of fraud or lawful basis to displace the charge, must be dismissed.
