The appeal is dismissed. The Court held the trial judge did not err in admitting the arbitration statement under the interests of justice exception, and his adverse credibility findings against the defendant's principal witness and factual findings on variations, defects and quantum were open to him on the evidence. There was no miscarriage of justice requiring a retrial; the trial judgment awarding the plaintiff $17,316,533.11 together with interest and costs stands.
