The recorder found both the bus driver (1st defendant) and the tow truck driver (3rd defendant) negligent and equally liable because the bus driver failed to reduce speed and take added precautions despite hazard warnings while the tow truck driver made an un signalled risky U‑turn; on the balance of probabilities the accident caused the plaintiff's cervical injury (or triggered pre‑existing hypersensitivity); damages were assessed accordingly and judgment entered against all four defendants with costs nisi.
