Ex facie title deeds showed a joint deposit by Wong and Kwan which raised a presumption of resulting trust in favour of Wong; that presumption is not displaced without proof of a qualifying relationship (marriage, parentage or locus parentis); absent such proof the purchaser's requisition was reasonable; the Defendant cured the defect by later producing a marriage certificate but failed to take adequate procedural steps earlier and therefore must pay the costs of the summons.
