The court concluded the arbitrator committed errors of law by failing to take into account Zebra's amended claim in the statutory declaration, by failing to address and give reasons on the Investment and Business Plan and Venture Capital Clauses (and related loss of chance/consequential loss arguments), and by giving inadequate reasons in rejecting the misrepresentation claim; accordingly the court remitted those parts of the Award to the arbitrator for reconsideration with the court's opinion on the questions of law; costs ordered to follow the event.
