    It was not unreasonable for the plaintiff to commence and to continue the action in the District Court given the circumstances at issuance and the evidence including that the award with interest was marginally below the District Court limit; therefore the costs order nisi remains appropriate and is made absolute and the defendant must pay the plaintiff's costs to be taxed on the District Court scale (with plaintiff's own costs taxed under Legal Aid Regulations).
