The Court of Appeal held that (1) the statutory power of advancement under s34 Trustee Ordinance can be exercised by executors before completion of administration of an estate and before the relevant beneficiary's interest has vested in possession, and (2) the s34 power can also be used to pay or apply trust property already absolutely vested in possession in an adult beneficiary of full capacity (subject to the beneficiary's right to call for distribution).
