- Court
- Court of Appeal
- Case number
- CACV296/2007
Appeal allowed: the judge below erred in construing a positive permission to use Norwich Pharmacal disclosure as an implied prohibitory restriction and was wrong to find breach based on publication of documents read at an open hearing; a final Norwich Pharmacal order does not carry implicit restrictions on use beyond its express terms and the court lacked justification to dismiss the actions or to make a blanket prohibition on future Norwich Pharmacal applications; therefore the orders of 30 June and 8 August 2007 must be set aside in the respects challenged.
