A Norwich Pharmacal / pre-action discovery order was granted because the plaintiff established a prima facie case that the stolen funds were transferred into a virtual account linked to the defendant and that, notwithstanding abandonment of proprietary claims, the plaintiff can raise a prima facie unjust enrichment claim against second-tier recipients by tracing an interest in the stolen monies and showing a sufficient causal nexus; it is for the recipient(s) to establish any defence.
