Trial judge erred by deciding the appellant had in fact made the confession at the admissibility stage instead of assuming it for the voluntariness inquiry; the judge failed to properly assess whether the prosecution had proved voluntariness beyond reasonable doubt; on rehearing the appellate court concluded the prosecution did not prove voluntariness and without the confession there was no evidence to support the conviction, therefore conviction and sentence were quashed.
