Section 30 applies in these circumstances because Walkley is confined to cases where a second action is against the same defendant; here a different defendant (Hospital Authority) was sought to be joined, the HA had been aware and involved from the outset and suffered no substantial prejudice from the short delay caused by solicitors' oversight, so on balance it was equitable to dis-apply the limitation period and allow joinder.
