Defendant breached its duty by creating or permitting a slippery contaminant on the pedestrian way during/after cleaning and failing to give visible warning; that breach caused the plaintiff's fall and injuries; plaintiff was not contributorily negligent; damages awarded accordingly.

On the balance of probabilities the court found the restaurant floor was wet and slippery and that the defendant, as occupier, failed to take reasonable steps to ensure safety or provide adequate warnings; the defendant failed to discharge the evidential burden that the accident occurred without its negligence; the plaintiff was not contributorily negligent; therefore the defendant is liable under the Occupiers Liability Ordinance and damages were assessed accordingly.
