Because Ms Kwong elected to engage as a defendant by filing a defence and resisted discovery, thereby necessitating cross-examination and extra discovery steps, the court exercised its discretion to depart from full joint and several liability but to impose significant cost liability on her: she must pay the costs of and occasioned by her defence; 25% of the costs occasioned by the discovery application (including appeal, cross-examination and resulting discovery); and costs for specified affidavits only (the 5th, 6th and 7th) filed in support of her and related defendants' applications.
