On an objective reading of contemporaneous documents and correspondence the Administrator had in fact considered both the pre‑existing solicitor‑client relationship and legitimate performance concerns that Mr Daly was unable to take further cases; the Performance Reason in affidavits elucidated and formed part of the original reasons rather than being an ex post facto justification; accordingly Grounds 1 and 2 were not reasonably arguable and leave to apply for judicial review was refused, with Ground 3 dismissed as dependent on those grounds.
