The shop was a public place; the appellants' collective conduct constituted loitering which reasonably caused concern for the well-being of the shop staff; where a group acts in furtherance of a common purpose to create a nuisance individual proof of each defendant's specific act is not required, therefore the magistrate was entitled to convict and the appeal is dismissed.
