Leave to adduce the ZL Memo and Wu Affirmation was refused because Condition 1 of Ladd v Marshall was not satisfied: the Court inferred the new evidence could have been obtained for use at the CFI hearing with reasonable diligence. Having so found, it was unnecessary to consider Conditions 2 and 3 or the Flywin principle; the applications were dismissed and costs ordered to follow the event on the usual party-and-party basis.
