The court held the three year delay was not inordinate given the disappearance of a main witness and, because the prosecution relied largely on documentary evidence, no prejudice to the applicant was shown; withdrawal and subsequent recharging were lawful under s.76 of the District Court Ordinance; and the applicant's guilty plea meant there was no merit in his application for leave to appeal, so leave was refused.
