The applicant’s five‑month unexplained delay was inordinate; he failed to identify any arguable legal error or procedural unfairness in the Director’s or Board’s decisions; the Board validly allowed the applicant’s informed withdrawal and became functus officio; the Director’s findings of low risk and availability of internal relocation were not legally challengeable on the record. Accordingly there was no good reason to extend time and the leave application had no prospect of success.
