Withholding part of an interdicted police officer's pay under the express statutory power in s17(2)(a) of the Police Force Ordinance does not, by itself, violate Article 11(1) HKBORO where the measure is regulatory and aimed at legitimate objectives (protecting public purse, maintaining public confidence, addressing effects of interdiction), statutory safeguards exist (minimum entitlement, reimbursement if not punished, post‑conviction provisions) and the policy guidelines do not amount to a presumption of guilt or an unlawful fetter on discretion.
