Because a bona fide conflict arose between the assistant solicitor's affirmation and the magistrate's affidavit and clause 3(d) of the magistrate's affidavit left a residual doubt as to whether an inappropriate indication to reconsider plea was given, the appellant was entitled to the benefit of that doubt; accordingly the conviction was quashed; additionally the court set out correct procedure for challenging trial records and affirmed admissibility but weight-based assessment of a witness who remained in court.
