On the balance of probabilities the court preferred the mother's credible oral and witness evidence over the widow's inconsistent and earlier sworn statements; the statutory definition and s.6(1) entitle a parent to claim dependency; credible evidence of monthly cash payments justified finding the mother was a dependant and that the appropriate measure of dependency was HK$2,500 per month.
