The magistrate's factual findings that the CCTV footage corroborated the complainant and that the appellant acted as leader instructing the assault were supported by objective evidence and proper evaluation of credibility; there was no legal error in accepting the complainant's explanation for omissions, therefore the conviction for counselling assault occasioning actual bodily harm is safe and is upheld, while the second charge was properly acquitted on reasonable doubt.
