On the balance of probabilities the accident occurred as described but Success was not liable because the task was an everyday simple operation for which the employee could reasonably decide how to act, safer movable alternatives (guest chairs) were available, res ipsa loquitur did not apply, and there was insufficient proof that the employer's omission to provide a ladder caused the accident or amounted to unreasonable breach of duty.
