LAM KA LOK LOUIS v. SWIRE PROPERTIES MANAGEMENT LTD

    Citation
LAM KA LOK LOUIS v. SWIRE PROPERTIES MANAGEMENT LTD
    Court
    Court of First Instance
    Case number
    HCPI914/2003

Although the court accepted the plaintiff's account of how the injury occurred, the plaintiff failed to prove negligence or breach of statutory duty because the defendant had a reasonable system of daily engineer inspections, there was no evidence the defendant knew or ought to have known of the jammed door, the task (removing a half full 15 litre bucket weighing about 16–17 lbs) was not hazardous, the plaintiff had reasonable alternatives (wait for engineers or obtain coworker assistance), and the risk of serious injury in the described manner was not foreseeable to the defendant.
