The trial judge correctly applied the Turnbull identification principles, properly evaluated the witness's opportunity to observe (lighting, proximity, prior familiarity and post-event recognition), rationally rejected inconsistent minor evidence (bar manager) and, absent any defence explanation, the identification was reliable so the conviction was not unsafe and leave to appeal was refused.
