The magistrate's findings on credibility and fact were not plainly wrong, the alleged inconsistencies were immaterial, the defence of self-defence was not established on the evidence, and the prosecution proved the elements of s19 OAPO beyond reasonable doubt; appeal dismissed.

The Court held the original sentence for false imprisonment was unduly lenient given the interwoven nature of the false imprisonment and wounding, the use of weapons (hammer and cutter) and the respondent's recent similar offending against the same victim; the appropriate substituted sentence for false imprisonment is two years and nine months, the wounding sentence of 12 months is left undisturbed and both sentences are to run concurrently, producing an effective term of two years and nine months imprisonment.
