Given the evidence of prevailing commercial practice and local authorities, production of an original straight bill of lading was not required in Hong Kong for delivery; Defendant acted as agent for Sistemas and assumed no contractual or conversion liability to Plaintiff; Defendant did not refuse to supply the master bill and even if supplied it would not have enabled Plaintiff to recover the Mexican goods, therefore Plaintiff's claims fail.
