The High Court dismissed the appeal and affirmed the labour centre detention order imposed concurrently for both offences because, considering the mandatory closure order period, the large and concealed premises, the number of patrons (38), the volume of alcohol present, the offender's admitted culpability and background as reflected in reports, and the need for deterrence and rehabilitation, the sentence was within lawful discretion, s.109A(1) was considered and the sentence was not manifestly excessive.
