The applicant's unexplained delay of about two years in issuing the originating summons after leave was granted, together with available avenues for assistance and lack of evidence of effective non-receipt, did not constitute sufficient reason to extend time; therefore the application for extension was refused and the Unless Order was ordered to take effect.

The defendant is contractually liable to reimburse the plaintiff for the waiver fee assessed by the Government because the Licence clauses 3(a), 3(c) and 5(c) placed responsibility for government rent, rates and waiver fees on the occupier and required indemnity; plaintiff properly paid the Government demand to avoid enforcement and is entitled to recover the sum paid minus the waiver fee deposit held; the defendant's agency, misrepresentation, concealment and abandonment arguments fail to relieve him of liability.

The written abandonment of the applicant's leave application was effective and there were no grounds to treat that abandonment as a nullity; accordingly the application to treat the abandonment as nullity is dismissed.
