Leave to appeal out of time was refused because the applicant's unexplained delay (he absconded) disentitled him to the indulgence and because, applying the conversion of No.4 to No.3 heroin using the chemist certificate per Cheng Yeung, the effective quantity fell within the same Chan Chi Ming sentencing bracket (substantial: 150–1000 g) so refusal would not shut out a substantial and plainly arguable ground of appeal.
