    The court held that, applying s70(1)(a),(e) and (f), the bank suffered prejudice by granting the increased overdraft on the basis of false instruments (a temporary loss and an opportunity for the applicant to gain a financial advantage), and there was overwhelming evidence that the applicant intended both that the instruments be accepted as genuine and that the bank act to its prejudice; accordingly the application for leave to appeal against conviction lacked merit and was dismissed.
