Reduction of the footpath to a two metre passage did not prevent or inconvenience persons coming into or leaving the applicant's shops and therefore did not infringe the applicant's private right of access; accordingly no liability to statutory compensation arose. The applicant also failed to justify an extension of time because it gave no explanation for delay, did not discharge the burden of showing no prejudice to the respondent, and produced no materials warranting exercise of the Tribunal's discretion.
