Court accepted plaintiff made the 18 April 2001 deposit but held the plaintiff bore the evidential burden to prove the deposit was never withdrawn and remains held by defendant; plaintiff failed to discharge that burden because objective bank records (account closure on 3 January 2002), credible bank witness evidence on withdrawal procedures and record-retention policies made it more probable the deposit was withdrawn and not held by defendant; accordingly defendant not liable.
