The Court held the plaintiffs had not established a valid ancestral worship trust as required by precedent and formalities; the judge below erred in finding adverse possession because the defendant failed to prove the necessary physical possession and intention to dispossess co-owners; however, on the proper construction of the 1939 Division the defendant (and predecessor) had been appointed bailiff/collector of rents and therefore must render an account. The appeal was allowed to the extent of ordering an account and inquiry; injunctive relief was not made.
