On the evidence and late sworn admissions by FEL's authorised representative that FEL owed FEPCB monies (circa HK$3,000,000) and that earlier denials were false, together with expert evidence that a key document was a forgery, the court found FEL acted as FEPCB's agent, failed to account, and therefore FEPCB was entitled to an account, payment, declaration and injunctive relief; costs awarded to plaintiff to be taxed and paid by FEL on a common fund basis and FEL's counterclaim dismissed.
