The court held that the circumstantial evidence (Chan manipulating the lock at 2 a.m., possession of try‑out keys, the applicant standing nearby looking about and then walking off with Chan) irresistibly supported the inference that Chan lacked authority and that the applicant was acting in concert; there was no demonstrable error in the trial judge's assessment and the application for leave to appeal was therefore dismissed.
