Section 25(1) Cap.455 does not make the property’s status as proceeds an element of the actus reus; it requires proof that the defendant knew or had reasonable grounds to believe the property represented proceeds (mens rea). Given the trial findings that the conspirators intended the property to be proceeds, s159A(2) was academic in this case. Certification and leave to appeal were refused.
