Under s28(1) Cap.338 leave to appeal is confined to legal errors or jurisdictional excess; the appellant failed to demonstrate any legal error by the adjudicator and provided no reasonable excuse for his non-attendance or failure to notify the tribunal; accordingly leave to appeal is refused.

The appeal was dismissed because the judge properly exercised her discretion in refusing to adjourn: the debtor failed to show he could repay the debt within a reasonable time or provide a concrete IVA repayment timetable, and non‑compliance with the statutory demand justified the bankruptcy order.

The summons of 11 April 2012 to cancel the requirement to lodge security was dismissed because the order had been sealed and the applicant lacked an appropriate procedural basis to apply to set it aside; however a limited seven-day extension to lodge the court-ordered HK$200,000 was granted on 23 April 2012 because a short extension would not seriously prejudice the respondents; no order as to costs was made.
